License Suspension

Suspension of an Ohio Driver's License is an enforcement tool designed to bring those obligors who are in default on their child support orders back into compliance. Franklin County initiated its Driver's License Suspension Program in November of 2001. By the end of the Third Quarter 2002, the agency had suspended 1,356 Ohio driver's licenses and had collected $186,272 from obligors seeking to have their driver's license suspensions lifted.

The program works as follows: Prior to license suspension, the agency will send out a Default Notice to obligors who are more than 30 days in arrears on their payments. This notice will alert them to the potential for a driver's license suspension. These obligors will have the opportunity to request a due process hearing within seven business days from the date the Default Notice is issued. If the obligor in receipt of this notice should fail to request a hearing or make payment arrangements, CSEA support officers have the option of suspending that individual's driver's license.

The actual suspension of an Ohio driver's license is accomplished through an automatic interface between the SETS computer system and the Ohio Bureau of Motor Vehicles. Once the CSEA support officer "keys in" the suspension, the BMV will automatically:

  • Suspend any license currently held by the obligor.
  • Refuse to renew or issue any driver's license to the obligor.
  • Refuse to reinstate any license until notified by the CSEA.
  • Refuse to issue or renew a State of Ohio Identification Card.
Obligors whose driver's licenses have been suspended by the CSEA can have their license suspensions lifted by doing one of the following:
  • Paying their arrearage off in full.
  • Submitting to a wage withholding order and making a lump sum payment not less than a full month's current support plus liquidation amount, if any.
  • Submitting to a new child support order that has been modified to collect current support due plus an amount to liquidate the arrears.

Obligors who have made one of the above payment arrangements with the CSEA can then visit the BMV to have their driver's licenses reinstated. The BMV charges a $25.00 fee for reinstating the driver's license. Currently the only BMV office in Franklin County which is authorized to collect this fee and reinstate the license is the one located at 1583 Alum Creek Drive in Columbus.

If an obligor is currently complying with their current support order and making any ordered liquidation payments on an arrearage, their driver's license will not be suspended solely due to the fact that an arrearage exists on the case.
